Terms and Conditions for Job Applicants
Premier Labor Source LLC
By submitting a job application, registering through our platform, sending documents, or communicating with Premier Labor Source LLC (“the Company”), the applicant agrees to the following Terms and Conditions. These terms apply to the application, screening, communication, assignment, and potential employment process with the Company.
1. Acceptance of Terms
By submitting an employment application to Premier Labor Source LLC, the applicant confirms that they have read, understood, and accepted these Terms and Conditions.
Submitting an application does not guarantee employment, immediate placement, work hours, continued employment, or project availability.
2. Accuracy of Information Provided
The applicant confirms that all information provided in forms, applications, interviews, documents, messages, or any other communication is true, complete, current, and verifiable.
Premier Labor Source LLC reserves the right to reject an application, cancel the hiring process, remove a candidate from an assignment, or terminate employment if false, incomplete, altered, fraudulent, or omitted information is discovered.
3. Authorization for Verifications
The applicant authorizes Premier Labor Source LLC to conduct legally permitted verifications, including but not limited to:
- Identity and eligibility to work in the United States, including I-9 documentation.
- Employment history and professional references.
- Certifications, licenses, courses, or training required by the client or project.
- Criminal background checks, when legally permitted and applicable to the position.
- Attendance, performance, and compliance history in previous employment.
- Any other verification necessary to evaluate the applicant’s eligibility.
The applicant understands that certain positions, clients, or projects may require approval of these verifications before any assignment begins.
4. Consent to Communications
The applicant authorizes Premier Labor Source LLC to communicate by phone calls, SMS messages, WhatsApp, email, job platforms, or other digital channels for purposes related to recruitment, application follow-up, requirements, confirmations, work instructions, job opportunities, schedule changes, or administrative information.
The applicant acknowledges that it is their responsibility to keep their contact information updated.
5. No Guarantee of Employment, Assignment, or Hours
The applicant acknowledges and agrees that:
- Submitting an application does not guarantee employment.
- Immediate assignment is not guaranteed.
- A minimum number of weekly hours is not guaranteed.
- Opportunities depend on client demand, availability, and approval.
- Assignments may be modified, paused, or canceled by the client or the Company.
- The Company may suspend, modify, or cancel recruitment processes at any time.
6. At-Will Employment
If hired, employment with Premier Labor Source LLC will be considered “at-will” employment, in accordance with applicable law.
This means that both the employee and the Company may terminate the employment relationship at any time, with or without cause, and with or without prior notice, within the limits allowed by applicable state and federal law.
7. Use and Protection of Personal Data
Premier Labor Source LLC may collect, use, and retain the applicant’s personal information for purposes related to:
- Internal recruitment and selection processes.
- Evaluation of eligibility for available positions.
- Submission of profiles or professional information to clients.
- Compliance with employment, tax, legal, and administrative obligations.
- Registration, control, communication, and project assignment.
- Verification of documents, experience, and job requirements.
The applicant authorizes their name, experience, skills, certifications, employment history, and other relevant information to be shared with clients or authorized third parties solely for purposes related to job opportunities, evaluation, or legal compliance.
The Company will take reasonable measures to protect personal information in accordance with applicable privacy laws.
8. Availability, Requirements, and Project Assignments
The applicant understands that certain positions may require:
- Immediate availability.
- Flexible, night, rotating, or emergency schedules.
- Physical labor, lifting, use of tools, machinery, or specialized equipment.
- Travel or transportation to different job sites.
- Prior training, whether virtual or in person.
- Submission of additional documents.
- Compliance with specific client requirements.
Assignments are not guaranteed and depend on client needs, applicant availability, profile approval, and compliance with project requirements.
9. Conduct, Professionalism, and Compliance
Every applicant, candidate, or employee must comply with the professional conduct standards established by the Company and its clients, including:
- Punctuality for interviews, orientations, training sessions, and assignments.
- Respect toward supervisors, coworkers, clients, and Company representatives.
- Compliance with work instructions.
- Proper use of tools, equipment, and materials.
- Compliance with workplace safety policies and protocols.
- Timely communication regarding delays, absences, or issues.
The following are strictly prohibited:
- Offensive, discriminatory, threatening, or inappropriate language.
- Harassment, violence, intimidation, or disrespectful conduct.
- Reporting to work under the influence of alcohol, drugs, or controlled substances.
- Recording false hours or manipulating employment information.
- Leaving the job site without authorization.
- Violating safety rules or client instructions.
Failure to comply may result in disqualification, removal from a project, suspension, employment termination, or ineligibility for future opportunities.
10. No-Show, Absence, and Cancellation Policy
The applicant acknowledges that attendance and communication are important requirements for maintaining work eligibility.
The following may be considered violations:
- Failing to appear for interviews, orientations, training sessions, or assignments without prior notice.
- Repeatedly canceling confirmed assignments.
- Arriving late without reasonable notification.
- Leaving the job site without authorization.
- Failing to respond to important communications related to an assignment.
Whenever possible, the applicant must provide at least 24 hours’ notice if they are unable to attend a scheduled interview, orientation, or assignment.
Failure to attend, cancellations without notice, or job abandonment may result in temporary or permanent disqualification.
11. Safety, PPE, and OSHA Compliance
The applicant and future employee agree to comply with all applicable safety policies, including client internal rules, Company policies, and state or federal safety regulations, including OSHA when applicable.
The employee must:
- Properly use the required personal protective equipment.
- Follow safety instructions at all times.
- Immediately report hazards, incidents, accidents, or injuries.
- Attend mandatory safety training.
- Avoid improper use of tools, machinery, or equipment.
Premier Labor Source LLC will not be responsible for injuries, damages, or incidents caused by negligence, inappropriate conduct, failure to follow safety rules, or improper use of tools or equipment by the applicant or employee, except where applicable law provides otherwise.
12. Alcohol, Drug, and Substance Policy
It is strictly prohibited to report to interviews, orientations, training sessions, or job sites under the influence of alcohol, illegal drugs, controlled substances, or any substance that may affect performance, judgment, or safety.
The Company or client may request substance testing when permitted by law and required by project or client policies.
Violation of this policy may result in immediate removal, employment termination, or disqualification from future opportunities.
13. Schedules, Timekeeping, and Payments
The applicant and future employee understand that:
- Worked hours must be recorded accurately, completely, and honestly.
- Hours must be verified and approved by the client or authorized supervisor.
- The Company will process payments only for worked, verified, and approved hours.
- No minimum number of weekly hours is guaranteed.
- Any error, dispute, or correction of hours must be reported immediately.
- It is prohibited to record, report, or claim hours that were not actually worked.
Manipulation of schedules, falsification of records, or inaccurate reporting of hours may result in immediate termination and any additional actions allowed by law.
14. Limitation of Liability
To the extent permitted by applicable law, Premier Labor Source LLC will not be responsible for:
- Loss, damage, or theft of personal belongings.
- Cancellations, schedule changes, or project modifications made by clients.
- Assignment interruptions due to client decisions.
- Loss of work opportunities due to lack of availability, failure to meet requirements, or lack of client approval.
- Damages caused by negligent, unsafe, inappropriate, or unauthorized acts by the applicant or employee.
The Company’s liability will be limited to what is allowed under applicable state and federal laws.
15. Confidentiality
The applicant agrees to keep confidential any internal, commercial, operational, or administrative information belonging to Premier Labor Source LLC or its clients.
This includes, but is not limited to:
- Prices, rates, or business agreements.
- Internal processes.
- Client information.
- Employee or applicant data.
- Projects, locations, instructions, or internal documentation.
- Any non-public information obtained during the application, hiring, or assignment process.
The confidentiality obligation continues even after the application process or employment relationship ends.
16. Termination of Process or Employment Relationship
Premier Labor Source LLC may end the selection process, cancel an assignment, remove a candidate, or terminate employment if any of the following occurs:
- The applicant does not meet the position requirements.
- The applicant fails to provide requested documentation.
- The applicant provides false, incomplete, or fraudulent information.
- The applicant fails required verifications.
- The applicant shows inappropriate conduct or lack of professionalism.
- The applicant violates safety, attendance, or conduct policies.
- The client requests the candidate’s removal.
- The project ends, is canceled, or changes requirements.
- Legal, administrative, or operational reasons justify termination.
17. Modification of Terms
Premier Labor Source LLC reserves the right to update, modify, or replace these Terms and Conditions at any time.
The applicable version will be the one published on the platform, application form, website, or corresponding document at the time of registration or use.
Continued use of the platform, submission of information, or participation in recruitment processes after any update constitutes acceptance of the modified terms.
18. Applicant Confirmation
By submitting an application, documents, or personal information to Premier Labor Source LLC, the applicant confirms that:
- They have read and understood these Terms and Conditions.
- They accept the policies described herein.
- They authorize the use of their information for employment, administrative, and compliance purposes.
- They understand that submitting an application does not guarantee employment, assignment, or work hours.
- They acknowledge that any employment offered will be “at-will,” in accordance with applicable law.
